Meet Arjun. Arjun is a freelance graphic designer. He makes a decent living, invests in life insurance, and pays his electricity bills on time. He assumes that because his taxable income falls below the tax slab after his investments, he doesn't need to file an Income Tax Return (ITR).

Arjun is making a common mistake.

Many people believe that ITR filing is only for the "rich" or those who owe taxes to the government. However, the Income Tax Act, 1961, has specific rules that might make filing mandatory for you, even if you don't owe a single rupee in tax.

Let’s break down the legal jargon into a simple story to understand who must file, why, and what happens if you don’t.

1. The Golden Rule: The Basic Exemption Limit

The general rule is simple. If your total income exceeds the "Basic Exemption Limit," you must file a return under Section 139(1).

The Catch: This income is calculated before you claim deductions. For example, if you earn ₹6 Lakhs but invest ₹1.5 Lakhs in PPF (Section 80C) to bring your taxable income down, you still have to file because your gross income (₹6 Lakhs) crossed the limit.

• Current Limits: Under the new Default Tax Regime (Section 115BAC), the limit is ₹3,00,000. If you opt for the old regime, it ranges from ₹2,50,000 to ₹5,00,000 depending on your age.

2. The "High Spender" Clause (Even if You Earn Less)

Here is where many people get caught. You might earn very little, but if you spend or deposit large amounts, the law mandates you to file.

According to the provisos of Section 139(1) and Rule 12AB, you must file an ITR if, during the previous year, you:

• Foreign Travel: Spent more than ₹2 lakh on travel to a foreign country for yourself or anyone else.

• Electricity Bill: Paid electricity bills totaling more than ₹1 lakh.

• Bank Deposits: Deposited more than ₹1 crore in one or more current accounts, or more than ₹50 lakh in savings accounts.

• Business/Profession: Had business sales/turnover exceeding ₹60 lakh or professional gross receipts exceeding ₹10 lakh.

• TDS/TCS: If the tax deducted (TDS) or collected (TCS) from your income is ₹25,000 or more (₹50,000 for senior citizens).

3. The Foreign Asset Rule

Do you own stocks in Apple, Google, or Tesla? Or perhaps you have a bank account from a time you studied abroad? If you are a resident and hold any asset (including financial interest in any entity) located outside India, or if you have signing authority in any foreign account, Section 139(1) makes it mandatory for you to file an ITR, regardless of your income level.

What Happens If You Don’t File?

1. The Late Fee (Section 234F) If you miss the due date (usually July 31st), you have to pay a late fee. This is ₹5,000 generally, though it is reduced to ₹1,000 if your total income is below ₹5 lakh.

2. Interest Penalty (Section 234A) If you owe any tax and file late, you will be charged simple interest at 1% per month (or part of a month) on the tax amount from the due date until you actually file.

3. You Lose the Right to Carry Forward Losses Did you lose money in the stock market or your business this year? If you file your return on time (under Section 139(3)), you can "carry forward" these losses to set them off against future profits, lowering your future tax bill. If you don't file on time, this benefit is lost (except for house property loss and unabsorbed depreciation).

4. Best Judgment Assessment (Section 144) If you fail to file a return, the tax officer assesses your income to the "best of their judgment." This essentially means the officer decides how much you earned and how much tax you owe based on the information they have, and you lose the chance to present your own calculation first.

5. Prosecution (Section 276CC) In severe cases where the failure to file is willful, the law allows for rigorous imprisonment ranging from 3 months to 2 years. If the tax evaded exceeds ₹25 lakhs, the imprisonment can range from 6 months to 7 years.
